Cyber Attacks on US Federal Judiciary's Electronic Case Filing System: Russian Government Hackers Suspected
The US federal judiciary has been hit by a series of escalated cyber attacks, with the latest breach targeting its electronic case filing system. The attack has exposed sensitive data, including sealed indictments, arrests, and search warrants, from Case Management/Electronic Case Files and the Public Access to Court Electronic Records (PACER) system.
The Administrative Office of the United States Courts has stated that some filings contain confidential or proprietary information that is sealed from public view. Little is known about the attack, including the method of entry, the actors behind it, and the full scope of the breach. However, investigations and multiple reports suggest that Russian government hackers or nation-state actors linked to Russia are the suspected perpetrators.
The breach has focused on mid-level criminal cases in multiple district courts, potentially accessing confidential informants’ identities and sealed indictments. This poses risks of retaliation against those involved in law enforcement. The breach is considered an ongoing, urgent threat, prompting federal judiciary administrators and judges to implement additional security measures.
Judge Michael Scudder has pledged to modernize the agency's IT systems and introduce more rigorous procedures to restrict access to sensitive documents. Nick Tausek, lead security automation architect at Swimlane, supports these efforts and advocates for proactive security measures to be incorporated into the federal courts' systems' defenses.
The breach has led to calls for improvements in cybersecurity. Campaign group Fix The Court is urging the Federal Judiciary to speed up its modernization work to avoid similar attacks in the future. Fix The Court suggests that the Open Courts Act could help beef up cybersecurity by using modern technology to maintain the court records system.
Without the Open Courts Act, similar attacks on the US federal judiciary's electronic case filing system are likely to occur again. The judiciary is working with Congress, the Department of Justice, the Department of Homeland Security, and others to mitigate the risks and impacts of these cyber attacks. Replacing Case Management/Electronic Case Files and PACER is a top priority, but will take time.
Tausek also emphasizes the need for the Open Courts Act to replace the awkward, patchwork architecture currently in use. He believes that this could help strengthen the federal courts' cybersecurity defenses. As the investigation continues, it is crucial for the US federal judiciary to take decisive action to protect its electronic case filing system and the sensitive data it contains.
