Redtube Wins Legal Battle: Injunction Halts Cease and Desist Letters
Redtube users have received a legal victory. The platform obtained an interim injunction against 'The Archive AG', represented by Urmann and Colleagues, halting further cease and desist letters. This move follows a long-standing dispute over users' alleged infringement of copyrights while watching certain videos.
In 2012, Bavaria's then Minister of Justice and Consumer Protection criticized Urmann and Colleagues' plans, expressing concerns about their approach. The law firm sent thousands of cease and desist letters to Redtube users, accusing them of infringing 'The Archive AG's rights. Users were asked to sign a declaration of cessation and pay a 250 euro fine.
The legality of these letters and the lawyers' tactics has been doubted. Several lawyers filed a criminal complaint against Thomas Urmann, with charges including coercion and extortion. The Public Prosecutor's Office in Cologne launched an investigation into how Redtube users' IP addresses were obtained. Urmann + Colleagues has a history of controversial projects, including auctioning off cease and desist letters and attempting to publish a list of porn users. The law firm threatened to send out more cease and desist letters before Christmas.
Redtube's interim injunction against 'The Archive AG' and Urmann and Colleagues prevents further cease and desist letters. The legality of the law firm's previous actions remains under investigation. Users can now watch videos on the platform without fear of immediate legal action.
